Framework for Capacity Allocation (FCA) on RFC 1

The Ministers representing the Executive board of the rail freight corridor Rhine Alpine (former rail freight corridor 1) together with the Ministers representing the Executive Board of the rail freight corridor North Sea Mediterranean (former rail freight corridor 2) signed the first Framework for Capacity Allocation (FCA) for the rail freight corridor on the 20th December 2012. This Framework has now been updated and signed for the TT 2016 by the members of the Executive Board.
The updated version of the FCA has been developed together with rail freight corridor North Sea Mediterranean; all other rail freight corridors have been involved in the process with the aim for a harmonized Framework between the nine rail freight corridors. The first experience in 2014 with the 2012 FCA has been taken on board.
The Executive board of the Rhine – Alpine Rail Freight Corridor, as referred to in Article 8 of Regulation (EU) No 913/2010, has been established the 27 June 2011, its existence has been recognized by the signatory Ministers to the Agreement concerning the Executive board of the Rhine – Alpine rail freight corridor the 8 October 2014.
As member of the Executive Board, Switzerland accepts all provisions of this decision but the decision is based on European law which cannot create any obligations of a legally binding character for Switzerland. Therefore, Switzerland provides an assurance that all relevant legal provisions will be amended and will be in line with this decision to come into force for the timetable period 2016. Switzerland is integrating provisions in its legislation which will be equivalent to Regulation (EU) 913/2010.
This decision shall be without prejudice to the competence of the Member States and Switzerland regarding planning and funding of railway infrastructure.
